Terms of Service

Welcome to Tsundoku. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

1. Definitions

"Platform" refers to the Tsundoku website and all related services. "User," "you," and "your" refer to any person who accesses or uses the Platform. "We," "us," and "our" refer to Tsundoku and its operators.

2. Eligibility

You must be at least 18 years old and capable of forming a binding legal agreement to use this Platform. By creating an account, you represent that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Listing and Selling Books

• You may only list books that you legally own and have the right to sell.
• Listings must accurately describe the book's condition, edition, and any relevant details.
• You are responsible for setting a fair price. We do not guarantee that any listing will result in a sale.
• Counterfeit, pirated, or stolen books are strictly prohibited. Accounts listing such items will be terminated immediately.

5. Purchasing Books

• When you purchase a book, you enter into a transaction with the seller, not with Tsundoku.
• We facilitate payment processing but are not a party to the sale itself.
• All sales are final unless the item is materially different from its listing description.

6. Payments and Fees

Payments are processed through Stripe. By using our Platform, you also agree to Stripe's Terms of Service. Tsundoku charges a 10% platform fee on each completed sale, deducted from the seller's payout. Payouts are issued to sellers after the buyer confirms receipt of the book.

7. Shipping

Sellers are responsible for shipping books to buyers promptly after a sale is completed. We provide shipping labels to simplify the process, but the seller bears responsibility for packaging the book securely and dropping it off for delivery. Tsundoku is not liable for items lost or damaged in transit.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Misrepresent the condition, authenticity, or ownership of any book.
• Interfere with or disrupt the Platform's infrastructure.
• Attempt to gain unauthorized access to other users' accounts.
• Engage in price manipulation, shill bidding, or other deceptive practices.

9. Intellectual Property

All content, design, and code comprising the Tsundoku platform are owned by us or our licensors. You may not copy, modify, or distribute any part of the Platform without prior written consent. User-submitted content (such as book photos and descriptions) remains yours, but you grant us a non-exclusive license to display it on the Platform.

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We are not responsible for the accuracy of book information retrieved through barcode scanning or other automated lookups.

11. Limitation of Liability

To the maximum extent permitted by law, Tsundoku and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform, including but not limited to lost profits, lost data, or damage to reputation.

12. Indemnification

You agree to indemnify and hold harmless Tsundoku and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
